Intellectual Property Policy

Vehium, operated by its founders based in Cyprus, respects intellectual property rights and expects its users to do the same. This policy outlines our intellectual property protections, our use of third-party trademarks, and the procedures for reporting intellectual property infringement.

1. Vehium Intellectual Property

The following are proprietary to the Vehium founders and protected under applicable intellectual property laws:

  • Trademarks: The "Vehium" name, the "BurnoutOS" name, the Vehium logo, and all related branding, slogans, and trade dress.
  • Software: The Vehium platform source code, architecture, algorithms, user interface designs, and all related documentation.
  • Copyrights: All original content on the Vehium website and applications, including text, graphics, images, icons, and multimedia.
  • Trade secrets: Proprietary methods, processes, and technical know-how used in the development and operation of the Platform.

All rights are reserved. No part of the Vehium platform may be reproduced, distributed, modified, or used to create derivative works without prior written permission from the Vehium founders.

2. Trademark Usage Guidelines

Use of Vehium trademarks is subject to the following guidelines:

  • Permitted uses: Factual references to Vehium in reviews, articles, and integrations, provided the use does not imply endorsement or affiliation.
  • Prohibited uses: Using Vehium trademarks in a way that is likely to cause confusion about the source, sponsorship, or affiliation of products or services. This includes using our marks in domain names, product names, social media handles, or advertising without authorization.
  • Logo usage: The Vehium logo may not be modified, distorted, or combined with other marks without written permission.

3. Third-Party Trademarks & Vehicle Data

The Vehium platform allows users to input vehicle information including brand/manufacturer names (e.g., Toyota, BMW, Ford, Mercedes-Benz) and model names. These are trademarks of their respective owners. Important clarifications:

  • All vehicle brand names, model names, and logos displayed within the Platform are trademarks of their respective manufacturers and are used solely for identification and informational purposes.
  • Vehium is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer whose brand or model names appear on the Platform.
  • Vehicle brand and model data is stored as user-submitted text for the purpose of vehicle identification in service records. This constitutes nominative fair use, referencing products by their trademarked names for identification purposes as recognized by U.S. courts and the United States Patent and Trademark Office (USPTO).
  • Vehicle Identification Numbers (VINs) are standardized identifiers governed by ISO 3779 and are not proprietary to any manufacturer.

4. Copyright Policy & DMCA

Vehium respects copyrights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our Platform infringes your copyright, you may submit a DMCA takedown notice.

DMCA Takedown Notice Requirements

Your notice must include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material on the Platform that you claim is infringing, with sufficient detail to locate it.
  • Your contact information (name, address, phone number, email).
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification with:

  • Identification of the material that was removed.
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake.
  • Your name, address, phone number, and consent to jurisdiction.
  • Your physical or electronic signature.

5. Trademark Infringement Reporting

If you believe that content on the Vehium platform infringes your trademark rights, please submit a report including:

  • Your full name, company name, and contact information.
  • The trademark(s) at issue, including registration number(s) if registered with the USPTO or other trademark office.
  • Description of the content you believe infringes your trademark.
  • The URL or location of the allegedly infringing content on the Platform.
  • An explanation of how the content creates a likelihood of confusion.
  • A statement that you have a good faith belief that the use is not authorized.

6. Patent Notice

Certain aspects of the Vehium platform may be covered by pending or granted patents. If you believe the Platform infringes a patent you hold, please contact us at info@vehium.com with details of the patent and the specific functionality you believe infringes.

7. User-Generated Content & IP

Users of the Vehium platform may submit various types of content including business names, descriptions, and images. By submitting content to the Platform:

  • You represent and warrant that you own or have the right to use the content.
  • You grant Vehium a limited license to store and display the content solely for service delivery purposes.
  • You retain all ownership rights to your content.
  • You agree not to upload content that infringes the intellectual property rights of others.

8. Repeat Infringer Policy

In accordance with the DMCA and our commitment to protecting intellectual property:

  • We will terminate or disable accounts of users who are found to be repeat infringers.
  • A "repeat infringer" is a user who has been the subject of more than two valid infringement notices.
  • We reserve the right to terminate any account at our discretion if we believe the user is engaged in infringing activity.

9. Open Source Acknowledgments

The Vehium platform may incorporate open source software components. We acknowledge and comply with the license terms of all open source software used. A list of open source components and their respective licenses is available upon request.
